Welcome to RCD Performance, LLC ("we," "us," or "our"). These Terms of Service ("Terms") govern your purchase and use of automotive parts, including remanufactured parts and resold products from other brands, through our website https://rcdperf.com/, physical stores, or other sales channels. By accessing our services or making a purchase, you agree to be bound by these Terms. If you do not agree, please do not use our services or purchase our products.
1. Products and Services
We remanufacture and sell automotive parts and resell high-quality automotive parts from trusted brands. All products are sold "as is" unless otherwise specified in writing. Product descriptions, specifications, and availability are subject to change without notice. We strive to provide accurate information but do not warrant that product descriptions or other content are error-free. Information on our website is provided "as is" with no guarantee of accuracy or completeness, and we are not liable for actions taken in reliance on such information.
2. Orders and Payment
Order Acceptance: All orders are subject to our acceptance. We reserve the right to refuse or cancel any order for any reason, including pricing errors, inventory issues, or suspected fraud.
Payment: You agree to pay the total amount due at the time of purchase, including applicable taxes and shipping fees. We accept payments via credit/debit cards and other methods as specified at checkout.
Chargeback Policy: By purchasing from us, you agree not to initiate a chargeback with your payment provider unless you have first contacted us to resolve the issue and given us a reasonable opportunity (at least 30 days) to address it. Chargebacks initiated more than 60 days after the purchase date are considered invalid, and you agree to indemnify us for any costs, fees, or losses incurred due to such chargebacks. We reserve the right to pursue legal action to recover funds from unauthorized or fraudulent chargebacks.
Pricing Errors: If a product is listed at an incorrect price due to a typographical or system error, we reserve the right to cancel or adjust the order and issue a refund or charge the correct price.
3. Shipping and Delivery
Shipping: We ship to addresses worldwide. Shipping costs and estimated delivery times are provided at checkout. We are not responsible for delays or damages caused by third-party carriers, customs processes, or events beyond our control (e.g., natural disasters, strikes).
Risk of Loss: Risk of loss and title for products pass to you upon delivery to the shipping carrier. You are responsible for inspecting products upon receipt and reporting any shipping-related damages to us and the carrier within 7 days.
4. Returns and Refunds
Return Policy: Products may be returned within 30 days of delivery, subject to our Return Policy. Returns must be unused, in original packaging, and in resalable condition unless defective. You are responsible for return shipping costs, and we do not pay for return shipping under any circumstances. Items may be subject to a 20% restocking fee due to packaging damage, cleanliness, or similar issues, at our discretion.
Refunds: Approved refunds will be processed within 14 days of receiving the returned product. Refunds are issued to the original payment method and will not include original shipping costs incurred. Any applicable restocking fee will be deducted from the refund amount.
Non-Returnable Items: Custom-ordered parts, special-order products, and used or installed products are non-returnable.
5. Limited Warranty
Remanufactured Parts: Our remanufactured parts come with a limited warranty of 12 months from the date of purchase, covering defects in materials and workmanship under normal use. The exclusive remedy for a defective product is repair, replacement, or refund, at our discretion.
Resold Products: Products from other brands are subject to the original manufacturer’s warranty, which is typically 2 years for new products and 90 days for spare parts or reconditioned products, covering defects in materials and workmanship. The exclusive remedy for a defective product is repair or replacement, at the manufacturer’s discretion. We do not provide additional warranties for resold products.
Professional Installation Required: Due to the nature and complexities of modern diesel engines, all our products must be installed by trained professionals. Failure to have products installed by a qualified professional may void the warranty.
Disclaimer of Implied Warranties: The express warranties provided above are in lieu of all other warranties, express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose.
Exclusions: Warranties do not cover failures resulting from improper use, lack of maintenance, improper installation (including installation by non-professionals), alteration, or use in applications outside the manufacturer’s original specifications.
Warranty Claims: To make a warranty claim, contact us at sales@rcdperformance.com or 309-822-0600 with proof of purchase and details of the issue. We may require the return of the defective product for inspection. For resold products, warranty claims may be processed through the manufacturer’s authorized channels as directed.
6. Limitation of Liability
To the fullest extent permitted by law, RCD Performance, LLC and its suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising from or related to your purchase or use of our products. We offer high-performance parts, such as high-output fuel pumps, designed to increase horsepower, and we cannot be held liable for any incidental or consequential damages resulting from the use of these parts. We do not assume liability or responsibility for any losses incurred due to a defective product. Our total liability, and that of our suppliers, for any claim, including those related to defective products, shall not exceed the original purchase price of the product. We are not liable for damages caused by factors beyond our control, including but not limited to improper installation (including installation by non-professionals), misuse, accidents, environmental conditions, or third-party actions. We do not accept liability for recommendations provided in drafts, drawings, or other documents, and we reserve all rights to our intellectual property.
7. Third-Party Websites
We are not liable for the content of third-party websites linked from our site. Accessing such websites is at your own risk, and we do not endorse or warrant the accuracy, reliability, or legality of their content.
8. Indemnification
You agree to indemnify, defend, and hold harmless RCD Performance, LLC, its affiliates, officers, directors, employees, agents, and suppliers from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, misuse of our products, or initiation of unauthorized chargebacks.
9. Governing Law and Dispute Resolution
These Terms are governed by the laws of Illinois, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration in Peoria, Illinois, in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration.
10. Modifications to Terms
We may update these Terms at any time by posting the revised version on our website. The updated Terms are effective upon posting. Your continued use of our services or purchase of our products after such changes constitutes your acceptance of the revised Terms.
